Terms and Conditions of Sale and Use
1. Preamble
This document (the "Terms") sets out the conditions under which Renc'Art provides, through its website (the "Site"), all services related to the promotion, presentation, enhancement, and sale of artworks, art objects, handcrafted creations, and activities within the visual arts and fine crafts sector.
By accessing the Site or using any of its services (purchasing an item, registering for an activity, attending an event, submitting an inquiry, or applying as an artist, etc.), you agree to these Terms without reservation. If you do not agree, you must not access or use the Site.
The terms "we," "our," and "Renc'Art" refer to the Renc'Art boutique-gallery. The term "you" refers to any user, visitor, or customer of the Site.
2. Scope of Application
These Terms apply to all interactions conducted through the Site, including but not limited to:
the sale of artworks, art objects, and handcrafted creations;
registration for events, workshops, or cultural activities;
requests for information or personalized services;
submission of an artist portfolio or project.
They complement, where applicable, other policies available on the Site, such as the return policy, privacy policy, or specific terms applicable to workshops and events.
3. Access and Use of the Site
3.1 You represent that you have the legal capacity to enter into a contract or that you have the authorization of your legal guardians.
3.2 You agree to use the Site in compliance with applicable laws and these Terms, without impairing its proper functioning.
3.3 The following actions are strictly prohibited:
transmitting viruses, malicious code, or attempting unauthorized access;
using the Site for fraudulent, defamatory, or unlawful purposes;
infringing upon the intellectual property rights of Renc'Art, its partner artists, or any third party.
3.4 Renc'Art reserves the right to deny or suspend access to the Site or to cancel an order in the event of non-compliance with these Terms.
4. Products, Services, and Availability
4.1 All items offered (artworks, art objects, handcrafted creations) are handmade and may present slight variations in color, texture, shape, or size, which are an integral part of their uniqueness.
4.2 Photos, descriptions, and dimensions are provided for reference only. Despite our best efforts, minor differences may occur between the displayed image and the actual product.
4.3 Prices, availability, and product characteristics may be changed at any time without notice. An order is deemed confirmed only upon full payment.
4.4 Renc'Art reserves the right to limit or cancel any order deemed abnormal, fraudulent, or contrary to its interests.
5. Orders, Payment, and Invoicing
5.1 You must provide accurate and up-to-date information when placing an order.
5.2 Payment shall be made using the methods specified on the Site. Renc'Art does not have access to your banking data, which are processed by a secure payment provider.
5.3 In the event of a manifest pricing error, Renc'Art reserves the right to cancel the order.
5.4 A digital or paper invoice may be issued upon request, in accordance with applicable legal requirements.
6. Delivery, In-Store Pickup, and Customs
6.1 Items may be shipped, collected at the boutique, or delivered according to the option selected at checkout.
6.2 Delivery times are provided as estimates and depend on the carrier and logistical conditions.
6.3 Any customs duties, import taxes, or additional charges are the responsibility of the buyer.
6.4 The risk of loss or damage transfers to the buyer once the parcel is handed to the carrier or collected in-store.
7. Returns, Exchanges, and Cancellations
7.1 Artworks, Handcrafted Creations, and Art Objects
All items sold by Renc'Art (artworks, handcrafted creations, and art objects) are unique and fragile; therefore, all sales are final.
However, an exchange may be granted under specific conditions:
Delivered purchases: the exchange must be completed within seven (7) days following receipt of the order;
In-store purchases: the exchange must be completed within seven (7) days following the transaction.
Exchanges are handled exclusively in person at the Renc'Art boutique, located at 1415 Avenue Maguire, Québec.
Returns by shipping are not accepted.
To be eligible for exchange, the item must:
be intact, unused, and in its original packaging;
be accompanied by the proof of purchase;
be exchanged for another item of equal or greater value.
All transportation costs incurred to return the item to the boutique are the responsibility of the customer.
No refunds are provided, except in cases of an error attributable to Renc'Art (damaged or incorrect item).
If damage is noted upon receipt, the customer must contact Renc'Art within twenty-four (24) hours of delivery, including photos of the parcel and damaged item as evidence.
Renc'Art is committed to reviewing each case carefully and finding a fair solution whenever possible. Our priority remains the full satisfaction of our customers.
After-Sales Service and Post-Purchase Responsibility
Renc'Art offers no after-sales service for items sold in-store or online.
Once the transaction is completed (in person or online), Renc'Art assumes no responsibility for the use, maintenance, deterioration, breakage, or damage of any item, whether occurring immediately or after delivery.
Each artwork or handcrafted item must be handled with care by its purchaser.
No compensation or repair can be claimed from Renc'Art for damages occurring after the sale or after receipt of the item.
7.2 Workshops, Events, and Activities
All registrations for workshops, events, or other activities organized by Renc'Art are non-cancellable and non-refundable.
No refunds will be issued in the event of absence, and no replacement sessions will be offered.
Each participant must be registered in advance.
Since the number of places is limited, one registration corresponds to one participant only.
Renc'Art reserves the right to cancel a workshop, event, or activity if the number of registrations is deemed insufficient. In such cases, participants will receive a full refund.
If a workshop, event, or activity is cancelled due to reasons attributable to Renc'Art, such as a storm, instructor unavailability, or any other situation beyond participants' control, a full refund will also be provided.
8. Intellectual Property
8.1 All Site content (texts, visuals, photographs, graphics, logos, descriptions, designs, etc.) as well as the artworks presented remain the exclusive property of Renc'Art or their respective authors.
8.2 Any reproduction, distribution, modification, or use, in whole or in part, without prior written consent, is strictly prohibited.
8.3 You may post comments or reviews on the Site; such contributions must remain respectful and not infringe on third-party rights. Renc'Art reserves the right to delete any content deemed inappropriate.
9. Liability and Warranties
9.1 Products and services are offered "as is." Renc'Art does not guarantee that they will meet all of your subjective expectations.
9.2 Renc'Art disclaims any responsibility for Site interruptions, technical errors, force majeure, data loss, or indirect damages.
9.3 In any case, Renc'Art's total liability for proven damages shall not exceed the total amount of the related order.
Disclaimer of Warranty and Post-Sale Liability
Renc'Art expressly disclaims all warranties, whether express or implied, regarding the durability, resistance, or maintenance of artworks, art objects, and handcrafted creations sold.
No claim will be accepted for any damage, breakage, crack, wear, discoloration, or alteration occurring after purchase or following delivery.
The purchaser acknowledges that all items sold by Renc'Art are unique, handcrafted, and delicate pieces that may present natural variations and must be preserved under appropriate conditions.
10. Indemnification
You agree to indemnify and hold harmless Renc'Art, its directors, employees, artists, and partners from any claim or damage arising from:
your use of the Site or its services;
your breach of these Terms;
your violation of any third-party rights.
11. Force Majeure and Suspension
Renc'Art shall not be held liable for any failure to perform due to an event of force majeure, including but not limited to natural disasters, pandemics, strikes, war, cyberattacks, supply disruptions, or any event beyond its control.
12. Amendments to the Terms
Renc'Art may modify these Terms at any time. The most recent version is the one displayed on the Site and takes effect upon publication. Continued use of the Site after such updates constitutes acceptance of the revised Terms.
13. Governing Law and Jurisdiction
These Terms are governed and construed in accordance with the laws of the Province of Quebec (Canada).
Any dispute or claim arising out of or relating to these Terms shall fall under the exclusive jurisdiction of the courts located in Quebec City, Province of Quebec, Canada.
In the event of a discrepancy between the French and English versions, the French version shall prevail.
